Criminal cases often involve complex questions about a defendant’s mental state. Courts rely on expert psychiatric and psychological evidence to decide whether an individual is fit to plead, whether their actions were influenced by mental illness and what sentencing or treatment is appropriate. Our clinicians have extensive experience in forensic psychiatry and psychology and provide clear, impartial opinions that assist judges and juries in reaching fair conclusions.

We offer a full range of criminal psychiatric and psychological services, delivered by section 12 approved forensic psychiatrists, clinical and forensic psychologists. Our services include:

Fitness to plead and stand trial assessments

Determining whether an individual has the capacity to understand court proceedings, instruct solicitors and participate in their defence. This can include individuals with psychosis, intellectual disability and neurocognitive disorders. All our experts rely on relevant legislation and case law in forming opinions.

Homicide evaluations

Assessing the presence and role of mental disorder in homicide, and following legislation to provide an expert opinion to the Court on the availability of the partial defence of diminished responsibility or the full defence of insanity. Whilst loss of control does not rely on psychiatric evidence, we have experts who can comment on relevant issues for this defence where appropriate.

Specialised expert witness categories

Whilst our experts work across a wide range of criminal cases, we can offer clinicians with specific expertise in serious crimes such as homicide, arson and sexual offending. Our child and adolescent psychiatrists excel in assessing individuals under 21 when a more developmental approach is needed to understand offending (for example in autism). We have experts in trauma and in dementia, where adaptations may be needed to aid participation in Court.

Diagnostic and formulation reports

Offering comprehensive psychiatric or psychological diagnoses, formulations and evidence-based recommendations for management and treatment.

Insanity

Our forensic psychiatrists will assess this complex medicolegal concept wherever potentially relevant, and form their opinions based on the M’Naghten Rules.

Risk assessments

Evaluating the likelihood of reoffending and dangerousness, and making recommendations to manage risk through treatment or supervision.

Sentencing advice

Providing opinions on appropriate sentencing options and rehabilitation requirements based on mentally disordered offender sentencing guidance.

Court testimony

Presenting findings clearly and confidently in court and responding to cross-examination. Our experts adhere to the duties of impartiality and objectivity, ensuring their primary responsibility is to the court.
