Housing cases

Housing cases encompass a range of legal issues – from possession proceedings and injunctions to claims about the impact of disrepair on health. Poor living conditions can lead to respiratory problems, allergies and mental health conditions such as anxiety, depression and stress. MLUK’s expert witnesses provide impartial medical and psychological evidence that meets court standards, helping judges and tribunals understand the impact of poor housing and guiding fair outcomes.

We adhere to legal aid rates, and provide competitive rates for private paying clients.

What we offer

We provide a comprehensive suite of expert witness services for housing cases. Our team includes psychiatrists and psychologists who assess the role of psychological and psychiatric conditions on individual behaviour relevant to housing matters, offering clear, evidence-based reports for courts, tribunals, and legal proceedings. Our services include:

Psychiatric assessments

Assessing the presence of any mental disorder and its role in contributing to behaviours of concern in housing cases. We provide opinions on whether individuals meet criteria for disability under the Equality Act 2010, their capacity to comply with housing conditions, and make recommendations around treatment and support.

Psychological evaluations

Assessing the emotional impact of poor living conditions, including anxiety, depression and stress.

Possession and injunction proceedings

Preparing expert witness reports to support or challenge possession and injunction applications.

Capacity and litigation reports

Assessing mental capacity where housing cases involve vulnerable adults or complex decision making. We also provide litigation capacity reports where a party’s ability to participate in proceedings is in question.

Expert witness reports

Producing clear, comprehensive reports that support legal claims and advise on necessary interventions. We ensure that reports adhere to court standards and can withstand scrutiny.

Court attendance

Providing oral evidence at hearings if required.

Our approach

Our clinicians work closely with environmental surveyors and housing specialists to correlate physical conditions with health outcomes. We conduct interviews and administer validated questionnaires to evaluate psychological impact. Our reports include recommendations for repairs, rehousing or support services to mitigate harm.
